Right to Grow and Consume Healthy Food
The battle continues in the Hershberger case. We have stayed them from rushing Vernon into trial and condemning him so far. We have forced a jurisdictional-challenge hearing on the judge for Friday March 2. Please fax and call the "officials" listed below who are trying to rob our right to grow and consume healthy food. We know and have the constitutional law on our side but the government and the courts need to be forced to follow constitutional law not their administrative law that does not follow constitutional law unless forced. We must force them.

Even the Wi Agricultural code exempts farmers, workers and owners from licensing and permits if only they consume the dairy, period. Remind them that the Nazis gained the greatest control of the people by restricting their farming and food rights and we will not permit it.
Take your and their time because they are trying to take your food rights. Be heard and make them listen. I am beyond the Mr. Nice-guy attitude toward tyrannical government agents, so if it is your demeanor to try gently to persuade them, wonderful. If it is your outrage that moves you, express it.

Healing and Health Issues
I've come to realize: start with food issues. I've done meditations, sports, etc., but none has done me a greater service than what I put into my body. Once I started to change my attitudes toward food, my health vastly improved.
I started this journey when my girlfriend suggested I check out [a site displaying your books] because she intuited some sort of affinity. I found out about this ascended master on [the site] and read some of the solstice channelings. Some of the teachings are too esoteric for me to comprehend, but what resonated was... advice to study and absorb the spiritual nature of food. Food that's cooked has little or no spiritual nurturing for us. You go to a supermarket and you can sense the elevated vibrations of the produce section and the low or dead vibrations of the refrigerated or processed foods sections. [The site] repeatedly points to the book We want to live, by Aajonus Vonderplanitz (rawmilk.org), which I finally ordered last Spring. It's become the most studied book I've had. I turn to it for any healing crisis I have and I've not visited a regular physician since I opened the book.
After a workshop and private session with Vonderplanitz,
I was onto my new food schedule. Weaned of coffee and alcohol, I found immediate health benefits in this new diet. The chronic health problems were gone over night and returned quickly when I didn't have access to my green juice during the week of moving into my house last month. Headaches though continued to flare up during stressful periods, but they now seem to have vanished, after I got my almgam fillings pulled a few weeks ago. John Butler, my healer in Syracuse, suggested I should get my teeth cleaned out now and not wait till I am healthier.
Right now, I am detoxing from mercury buildup and my lower back hurts a little, understandably. Some mercury leached into the body when the fillings were replaced (with plastic composites). Studies (with sheep) have shown that amalgam fillings leach into the body continuously, especially with hot beverages and foods. The kidney and the brain absorb the toxic metals, and I suspect now that many of us with lower back pain and/or urinary problems are fighting mercury poisoning. My back pain has been very subdued or vanished despite the mercury buildup in the kidneys due to the cilanthro I put in the green juice and the butter or coconut cream I eat with the juice. The fat traps the loosened mercury (made volatile by cilantro) and flushes it out of the body. Hot baths (with Epsom salt and baking soda for 22 minutes) help deal with flushing out radiation contamination and toxic metal through the skin, as does vigorous exercise.
Medical Myths
This raw foods diet dispels several medical myths and gives us tools to preach these new values:
1. fat is good: raw butter, raw coconut cream (homemade, with Greenstar juicer), raw avocados all are vital to build healthy fat cells in the body and strengthen the liver
2. eggs are great: raw eggs and lots of them heal during health crisis, take down swellings and flush out toxins. Forget the cholesterol scare.
3. eat starch in moderation: Aajonus suspects that my mother's heavy starch diet contributed to discoloring my eyes to brown. Now with this diet, the attempt is to bring them back to blue. Aajonus advises to eat a soft nut meal (ground nuts) only once a week.
4. raw [food] is an excellent source for healing.
5. raw milk is the best: this gets to the crux of our modern neurosis, that all milk and juices, etc., have to be processed, pasteurized and homogenized. Once I started drinking raw milk my teeth and gum pains disappeared.
6. green juices are beneficial: it's hard for our stomach to absorb raw vegetables, such as salads, especially cucumbers because they are high in fibers. With a Greenstar Juicer or other model that separates fiber and juice, we get a high energy drink; no need for coffee; well, I still retain my weakness for teas, even though I know full well that they make the body acidic.
I no longer accept that disease is the way of living, especially into old age.
I started on this new diet - and I have never followed any strict diet plan before -when I realized that quite a few of my friends had contracted cancer and some died because, as I suspected, of using chemotherapy. Given my own protracted health problems which could only be stabilized with antibiotics, I grew impatient and ask for new holistic perspectives. I no longer accept that disease is the way of living, especially into old age, I am no longer scared of cancers because I know that there's a way to reverse it, and it's not advertised by the medical establishment that pushes chemical treatment. Aajonus has been dubbed the guru of the 'underground raw milk movement' by the Wall Street Journal. They are taking note of us. Let's not be deterred by it, but convince ourselves to overcome fears and walk lightly on a new path of healthfulness.

This is a breath of fresh air after seeing the FDA team up with big-ag milk producers to squash people’s ability to access and consume truly nutritious products instead of continuing to rely on corporate produced dairy.
It’s wonderful progress to see such action to solidify these farmers’ rights and ability to provide safe and nutritious goods. Let’s hope it slows down the unnecessary raids and undue scrutiny so that raw food choice continues to grow in popularity and availability for consumers seeking healthier alternatives.

Raw Milk Conumers - Win a Battle Today and a War Tomorrow
Falls Church, Virginia (August 20, 2010) - In a complex federal district court ruling, Judge Mark W. Bennett refused to grant a motion by the United States Food and Drug Administration (FDA) to dismiss a lawsuit filed against the agency by the Farm-to-Consumer Legal Defense Fund (FTCLDF) and eight other named plaintiffs. The lawsuit argues that federal regulations (21 CFR 1240.61 and 21 CFR 131.10) prohibiting raw milk for human consumption in interstate commerce are unconstitutional as applied to FTCLDF’s members and the other plaintiffs named in the suit.
In his August 18 decision, Judge Bennett denied part of FDA’s motion to dismiss while reserving judgment on the remainder. As part of his ruling, the judge ordered proceedings in the case to be stayed sixty days to allow plaintiffs time to decide whether to file a ‘citizen petition’ with FDA. The petition would ask FDA to clarify its interpretation of the authorizing statutes and regulations giving the agency power to ban raw milk for human consumption in interstate commerce. If plaintiffs choose to file the citizen petition, the court would continue to delay the suit until the administrative proceedings were completed or until FDA failed to take action within the time the law requires. If plaintiffs declined to pursue the citizen petition, Judge Bennett indicated the court would reconsider FDA’s motion to dismiss.
In Judge Bennett’s view, the main question FDA needs to answer in the petition process is
whether § 1240.61 applies to and proscribes the conduct of (1) persons who travel from one state, where it is not legal to purchase raw milk, to another state, where it is legal to purchase raw milk, legally purchase raw milk, then return to
the original state where they consume the raw milk themselves or give it to their friends or family members; or (2) a principal and agent who agree that the agent will obtain raw milk out-of-state, where it is legal to do so, and to deliver it to the principal in the principal’s home state, where sales of raw milk are not permitted; or (3) a producer of raw milk who sells raw milk in an intrastate transaction to persons that he knows are from out of state.
All of the individually named plaintiffs in the lawsuit fit into one of the three scenarios described above. Section 1240.61 provides in part,
No person shall cause to be delivered into interstate commerce or shall sell, or otherwise distribute, or hold for sale or other distribution after shipment in interstate commerce any milk or milk product in final package form for direct human consumption unless the product has been pasteurized….
Judge Bennett sees the citizen petition as a way to resolve the question of
whether the plaintiff’s conduct involves or affects “interstate commerce” sufficiently to fall within the proscriptions of § 1240.61, and, still more specifically, whether the plaintiffs’ conduct constitutes “delivery [of raw dairy products] into interstate commerce” or “distribution” of raw dairy products after shipment in interstate commerce.
Plaintiffs have survived the first round in the case. They have until October 18 to determine what their next course of action will be.

The Right To Choose Healthy Food
DO PEOPLE HAVE THE RIGHT TO CHOOSE HEALTHY FOOD?
One group of about 800 well-educated Los Angeles people believe they do. The group has many doctors, lawyers and teachers. They have rejected all health department regulations for food preparation. They want food that has not been touched or exposed to chemicals of any kind. All food producers and markets today expose their foods, especially meats and dairy to chemicals of all kinds, from iodine and ammonia to bleaches. Plus most have been grown with pesticides, herbicides, chemical fertilizers and treated with additives.
This group of intelligent, health-conscious individuals calls their food club Right To Choose Healthy Food RAWESOME Club. They claim to have done their science homework that proves raw dairy is healthful and pasteurized dairy causes diseases from reports by the only true scientists of raw and pasteurized dairy Dr. William Campbell Douglass, Jr. M.D. and Aajonus Vonderplanitz, Ph.D. Nutrition. Both have not only had years of experience drinking raw milk themselves without incidents, they have observed and experimented with raw dairy for more than 40 years each with patients. Never have they seen an incident of food-poisoning from raw milk. They claim that medical doctors, FDA and CDC authorities have no experience with raw milk but plenty of prejudice against it because of the bad propaganda produced and paid for by the the pasteurized dairy industry early in the 20th century that falsely claimed raw milk caused typhoid and tuberculosis.
Last Wednesday, agents of USFDA, Los Angeles Prosecuting Attorney's office, California State Agriculture and Los Angeles County Health departments raided the food group and closed them down. They cited a lack of food health permits as cause but USFDA and California State were involved who have no jurisdiction over lack of county health food permit. Right To Choose Healthy Food's president and general manager Aajonus Vonderplanitz says that authorities want to ban raw dairy. Authorities confiscated mostly raw dairy products at the food club. Their warrant gave them permission to take samples for testing, such as vials or a bottle or two of each but authorities confiscated - Aajonus claims the correct word is stole - 17 huge coolers (3 ft X 1.8 ft. each). Mr. Vonderplanitz stated that authorities have been brainwashed against raw milk without any direct experience. They constantly claim that raw milk causes disease but have no science to support their clams.
Rawesome Club's members have leased animals and fields to own their own produce, so that it will be grown, produced and prepared the way they want it, healthfully. They pay the farmers for their services, including cultivating, boarding animals, collecting and packaging the foods members own for members only. Their club is not in the business of commerce; no one but the owners of the food - the members - get the food. Since members already own the food it is not commerce. Government has jurisdiction over commerce.
Los Angeles County Health Services tried to close the club in 2005 for the same reason but were informed that they had no jurisdiction and that no permits were required; members rejected health regulations for their own food. Now 5 years later, the same department accompanied by federal and state departments have repeated their stance that Rawesome operates without permit and it must have a permit., Mr. Vonderplanitz states, "We are ready to go to court to fight this. We have the right to healthy food the way we want it. Government does not have the right to tell us what we can eat and whether we are allowed to be healthy. They should mind their own business and follow the law. We are not in their jurisdiction. We have the right to eat healthy food."

Raw Milk Advocate Max Kane speaks
Joanne: Hello. Welcome to Joanne Unleashed. Today’s guest is Max Kane. He’s an advocate of raw milk, and he’s coming under a lot of fire by our government. In this interview he’s going to be talking about his health problems and how he recovered with raw milk and raw meat. He’s also going go share a lot of information on his views on the role of bacteria. This is a paradigm that most people are completely unaware of, and you do not want to miss this interview. So welcome.
Max: Thanks for having me.
Joanne: Tell me about the health problems that you had when you were younger.
Max: I grew up in the metropolis known as Chicago, so my body was bombarded with a lot of industrial pollution through the air and the water. My diet was extremely processed. I grew up on the average American diet, they call it the SAD diet where you’re eating fast food, and microwaved foods and so forth. At the age of ten my body completely broke down where it started expressing symptoms. It couldn’t handle the toxic load any more. The symptoms were terrible. Severe joint pain. Weight loss. I was wasting away. My skin was extremely pale and dry. I looked like one of those zombies from Night of the Living Dead. If you can imagine one of those zombies in a Nazi death camp. So I went to a medical doctor. They ran their tests and stamped me with a label. They said I had Crohn’s disease and it incurable, and they didn’t know exactly what caused it. I was really scared at the time. But they offered some relief through some medication which, due to my ignorance, I thought was a great idea at the time. I started taking medication. I was medicated for about ten years. After ten years I realized I wasn’t getting any results, and I was taking these pills every day. I was very committed to taking the pills. I have some friends in the inner city who sold crack, actually, and I was making an analogy through my mind how I myself was like a crack head, except going to the corner in the ghetto, I was going to Walgreen’s every month to get my pills. Through that analogy I started looking to the alternative realm. I was doing okay financially at the time, so I started buying more expensive food and shopping at Whole Foods. That’s where I learned about organic food for the first time. I never knew what it was. And then from there my education just progressed and evolved into more of a natural foods, unprocessed foods diet. Then in my mid-twenties I started adhering to a totally unprocessed food diet, which means a raw diet—animal-based as opposed to vegan and vegetarian—so a lot of raw meat, eggs, dairy, vegetables as well. It’s like an all raw food, omnivorous-based diet leaning toward carnivorous. And there’s not really much material out about that as far as reading material. Except there are a couple good books by an author, Aajonus Vonderplanitz. He has two books: one called We Want to Live and the other called The Recipe for Living Without Disease. Other than that, no one’s really published on the subject except there was a cat study done by Francis Pottenger, Jr. back in the thirties, but that was on cats, never on humans eating raw meat. So I started that diet and my health totally turned around. I stopped taking all medication. I put on over 80 pounds of healthy, athletic weight. I’ve been asymptomatic for multiple years now, and I’m in total control of my health.
Joanne: What got you going into raw meat? Was it after reading that book? Or did you just naturally…
Max: No, no. I got into the raw meat before. I used to play professional billiards, and some of the people I played with were Filipino. They took me out to this sushi place, and it was the first time I ever had raw meat. It was raw fish. And I was kind of squeamish. But these were good friends of mine; I didn’t want to insult their culture. So I’m eating this raw salmon. This is like back in my early twenties before I even became conscious of nutrition. That was my first experience with raw meat. But then later when I saw this first nutritionist in my mid-twenties, his name was Jim Marlow, he was the one who suggested eating raw meat. I just ran with that idea, and my body flourished, my health flourished. It was really against everything they tell you. The whole paradigm about bacteria causing disease is not founded, according to my experience. It’s almost the exact opposite that bacteria aid disease—they help you rebuilt your body—and chemicals cause disease. So I’ve been doing my best to stay toxic-free and bacteria-heavy.

Legislators to Hear from Raw Dairy Proponents

Last week, Lancaster Farming and a number of other papers ran an excellent article, Raw Milk Debate Spills into Capitols and Courts by Michael Crumb, who covers Agriculture for the Associated Press an influential news wire service.
The article states:
Lawmakers in seven states — Georgia, Iowa, Missouri, New Jersey, North Dakota, Wisconsin and Wyoming — have introduced measures this year seeking to change laws governing raw milk. The Falls Church, Va.- based Farmer to Consumer Legal Defense Fund also has filed lawsuits in California, Iowa, Missouri, New York and Wisconsin challenging various aspects of states’ laws regarding raw milk.
I spoke to Pete Kennedy, President of the Farm-to-Consumer Legal Defense Fund (FTCLDF) over the weekend about Wisconsin, in particular. Ever since learning of Scott Trautman’s troubles (click on this link to see a video that will make you cry) with the state regulators, I have been concerned about what is going on there, in particular. I learned from Pete that Wisconsin, by far, has more dairy farms than any other state. And, what happens in Wisconsin, may not stay in Wisconsin, as Pete says “it is a bellwether state” for the work of his FTCLDF around the country.
Me, I am calling it ground zero. An explosion of interest in the raw milk issue has taken place, largely because of what is happening to farmers at the hands of Wisconsin bureaucrats. More citizens are starting to question the merits of outdated laws that would keep them from accessing a wholesome food product, especially when the product comes from your own cow.
Many of you are aware that a landmark decision on cow share programs was just rendered by a justice of the peace in Canada, and we need similar rulings and/or legislation in America.

DATCP last fall began a series of “enforcement actions” against a number of small farms it suspected of having cow boarding programs or “incidental” sales of raw milk (they interpret incidental to mean more than once to the same person–very strict, indeed). Their dragnet includes demanding business records from Max Kane, a raw dairy activist, Pepin County Family Farm, among others.
Pete Kennedy, Esq. of the Farm to Consumer Legal Defense Fund has this to say:
DATCP’s position is that if a dairy is unlicensed, milk produced at the dairy cannot leave the farm. This is in conflict with other Wisconsin law that recognizes the right of owners of dairy animals to board those animals on someone else’s property. The agency does not regulate those owning and boarding their own dairy animals to consume raw milk produced by those animals; however, DATCP is claiming that it is illegal for someone who owns a cow and boards the cow on another’s property to obtain raw milk from the cow. This is the agency’s position whether or not the dairy boarding the cow is licensed.

“This extremely detailed request for information from DATCP seems over the top and overly burdensome. As a former police officer, I understand the need to enforce existing laws on the books, but this request seems more like harassment than an effort to enforce existing law.”

I spoke with Max Kane this morning. He says of the 15,000 dairy farms in his state, only 18 are being targeted by DATCP for suspected raw dealings. He added that the majority of dairy farms in Wisconsin are smaller farms, not factories, with 20, 50, 100 cows. Kane believes that because they are doing traditional dairying, 80-90% of dairy farmers in the state drink their milk raw.
Max pointed out that even if 100 dairy farms in the state were doing a raw milk cow share, they would still represent an insignificant percentage of the overall dairy market.
What You Can Do to Help
A bill that will legalize the sale of raw milk and raw milk products has been introduced in both the Wisconsin General Assembly (AB 628) and the Senate (SB 434).
On March 10, the concerned public is invited to testify before the General Assembly House and Senate committees currently considering raw milk legislation to protect consumer access to the milk of their choosing. Max Kane told me that the bill is a good bill which would allow Grade A dairy’s to offer raw milk, as long as they have a sign which has the disclaimer: “raw milk doesn’t offer the protection of pasteurization”. Kane would like to see the bill come out of committee, unchanged, for a floor vote.

Farmer cleared of 'raw milk' charges

Natural foods advocates are claiming a victory today after a court ruling cleared a dairy farmer of a string of charges he faced because of the raw milk he sold to members of a cow-sharing consortium.
According to natural foods blogger Kimberly Hartke, Michael Schmidt was found not guilty in a verdict that took a judge more than two hours to read.
The judge "found that Michael had done his due diligence, developed a proper contract, and that everyone was informed," Hartke reported. "The judge went on to say that Michael met a need for the people."
The case against the Ontario, Canada, dairy farmer hearkens back to similar disputes in the U.S. over the same issue.
WND previously reported when Mennonite farmer Mark Nolt of Maryland had his farm raided by SWAT-type agents and was fined more than $4,000 and had his equipment confiscated for providing raw – or unpasteurized – milk to participants in his program.
In the Ontario case, the ruling from the Newmarket justice of the peace found the cow-sharing operation Schmidt runs out of his Durham farm does not violate milk-marketing and public-health regulations.
The ruling concluded a three-year war over his business and means his milk legally can be distributed to consumers who have purchased "cow shares" in exchange for access to the milk.

Drinking raw milk in Canada is not banned, but other laws require pasteurization on most commercial milk products. According to a report in the Globe and Mail, 10 U.S. states – including California, Maine, New Hampshire, Pennsylvania, South Carolina and New Mexico – allow licensed farmers to sell raw milk with a warning label at grocery stores.
In other states, like Canadian provinces with tighter restrictions, consumers often participate in a "cow-sharing" or some other arrangement to gain access to such products...

The Farm-to-Consumer Legal Defense Fund (FTCLDF) is considering taking action against the FDA on regulation 1240.61, the prohibition against raw milk for human consumption across state lines.
FTC is looking for plaintiffs, private citizens who wish to be listed in this complaint against the government. Specifically, they are looking for the following:
1. A citizen from state A (where it is illegal to buy/sell raw dairy) goes into state B to buy some raw dairy (where it is legal to buy/sell). Citizen then buys the dairy from a store or farm and takes it back to state A. Examples might be someone living in Reno, Nevada who goes across state lines to purchase raw milk in Reno, California, or someone living in New Jersey who goes to a farm in Pennsylvania to purchase raw milk and then take it home.
2. A citizen from state A (where it is legal to buy/sell) goes into neighboring state B (where it is also legal to buy/sell) and buys raw dairy from a store or farm (the closest store/farm is in state B) and takes it back to state A. For example, someone from Connecticut might go into Massachusetts to purchase raw milk.
3. A citizen from state A is a member of a cooperative located in state B. It is legal in state A to buy/sell but it is illegal to buy/sell in state B. The citizen goes to the cooperative in state B and picks up their raw dairy and takes it back to state A.
4. A citizen from state A is a member of a cooperative located in state B. It is illegal in state A to buy/sell but legal in state B to buy/sell. The citizen goes to the cooperative in state B and picks up their raw dairy and takes it back to state A.
5. A business owner is located in state A (where it is legal to buy/sell) and has customers that come from state B (where it is illegal). Customers from state B buy/sell raw dairy in state A and take it back to state b.
